Conferring legal personhood on purely synthetic entities is a very real legal possibility, one under consideration presently by the European Union. We show here that such legislative action would be morally unnecessary and legally troublesome. While AI legal personhood may have some emotional or economic appeal, so do many superficially desirable hazards against which the law protects us. We review the utility and history of legal fictions of personhood, discussing salient precedents where such fictions resulted in abuse or incoherence. We (...) conclude that difficulties in holding “electronic persons” accountable when they violate the rights of others outweigh the highly precarious moral interests that AI legal personhood might protect. The question of whether AI systems such as robots can or should be afforded moral agency or patiency is not one amenable either to discovery or simple reasoning, because we as societies constantly reconstruct our artefacts, including our ethical systems. Consequently, the place of AI systems in society is a matter of normative, not descriptive ethics. Here I start from a functionalist assumption, that ethics is the set of behaviour that maintains a society. This assumption allows me to exploit the (...) theoretical biology of sociality and autonomy to explain our moral intuitions. From this grounding I extend to consider possible ethics for maintaining either human- or of artefact-centred societies. I conclude that while constructing AI systems as either moral agents or patients is possible, neither is desirable. In particular, I argue that we are unlikely to construct a coherent ethics in which it it is ethical to afford AI moral subjectivity. We are therefore obliged not to build AI we are obliged to. Language isn't the only way to cross modules, nor is it the only module with access to both input and output. Minds don't generally work across modules because this leads to combinatorial explosion in search and planning. Language is special in being a good vector for mimetics, so it becomes associated with useful cross-module concepts we acquire culturally. Further, language is indexical, so it facilitates computationally expensive operations.

The term embodiment identifies a theory that meaning and semantics cannot be captured by abstract, logical systems, but are dependent on an agent’s experience derived from being situated in an environment. This theory has recently received a great deal of support in the cognitive science literature and is having significant impact in artificial intelligence. Memetics refers to the theory that knowledge and ideas can evolve more or less independently of their human-agent substrates. While humans provide the medium for this evolution, (...) memetics holds that ideas can be developed without human comprehension or deliberate interference. Both theories have profound implications for the study of language—its potential use by machines, its acquisition by children and of particular relevance to this special issue, its evolution. This article links the theory of memetics to the established literature on semantic space, then examines the extent to which these memetic mechanisms might account for language independently of embodiment. It then seeks to explain the evolution of language through uniquely human cognitive capacities which facilitate memetic evolution. (shrink)

When individuals learn from what others tell them, the information is subject to transmission error that does not arise in learning from direct experience. Yet evidence shows that humans consistently prefer this apparently more unreliable source of information. We examine the effect this preference has in cases where the information concerns a judgment on others’ behaviour and is used to establish cooperation in a society. We present a spatial model confirming that cooperation can be sustained by gossip containing a high (...) degree of uncertainty. Accuracy alone does not predict the value of information in evolutionary terms; relevance, the impact of information on behavioural outcomes, must also be considered. We then show that once relevance is incorporated as a criterion, second-hand information can no longer be discounted on the basis of its poor fidelity alone. Finally we show that the relative importance of accuracy and relevance depends on factors of life history and demography. (shrink)

We examined the role of emotion- versus fact-focused conversations in the details children reported about a stressful event and whether the details provided were prompted or spontaneously offered. We also tested how these conversational strategies, in conjunction with children’s emotion regulation skills, influenced children’s event-related distress. Children (N = 100 8- to 13-year-olds) experienced a stressor in the laboratory and were randomly assigned to participate in a fact-focused conversation (prompted about objective event elements) or an emotion-focused conversation (prompted about subjective (...) reactions to the event) with an unfamiliar adult. Caregivers reported on children’s emotion regulation skills. Children reported more overall prompted and spontaneous details in the fact-focused condition, but reported proportionally more spontaneous details than prompted detail in the emotion-focused condition compared to the fact-focused condition. Children with lower emotion regulation skills found the emotion-focused conversation (but not the fact-focused conversation) about the laboratory stressor significantly less distressing than children with high emotion regulation skills (when controlling for initial distress about the task). We propose that combining both fact- and emotion-focused conversational techniques may be most effective for encouraging detailed disclosures from children and for providing a respite from distress for children with emotion-regulation difficulties. Patients have received experimental pharmaceuticals outside of clinical trials for decades. There are no industry-wide best practices, and many companies that have granted compassionate use, or ‘preapproval’, access to their investigational products have done so without fanfare and without divulging the process or grounds on which decisions were made. The number of compassionate use requests has increased over time. Driving the demand are new treatments for serious unmet medical needs; patient advocacy groups pressing for access to emerging treatments; internet platforms (...) enabling broad awareness of compelling cases or novel drugs and a lack of trust among some that the pharmaceutical industry and/or the FDA have patients’ best interests in mind. High-profile cases in the media have highlighted the gap between patient expectations for compassionate use and company utilisation of fair processes to adjudicate requests. With many pharmaceutical manufacturers, patient groups, healthcare providers and policy analysts unhappy with the inequities of the status quo, fairer and more ethical management of compassionate use requests was needed. This paper reports on a novel collaboration between a pharmaceutical company and an academic medical ethics department that led to the formation of the Compassionate Use Advisory Committee. Comprising medical experts, bioethicists and patient representatives, CompAC established an ethical framework for the allocation of a scarce investigational oncology agent to single patients requesting non-trial access. This is the first account of how the committee was formed and how it built an ethical framework and put it into practice. (shrink)

This book is a qualitative, interpretive, phenomenological, and interdisciplinary, examination of food and food practices and their meanings in the modern world. Each chapter thematically focuses upon a particular food practice and on some key details of the examined practice, or on the practice’s social and cultural impact.

‘‘Undone science’’ refers to areas of research that are left unfunded, incomplete, or generally ignored but that social movements or civil society organizations often identify as worthy of more research. This study mobilizes four recent studies to further elaborate the concept of undone science as it relates to the political construction of research agendas. Using these cases, we develop the argument that undone science is part of a broader politics of knowledge, wherein multiple and competing groups struggle over the construction (...) and implementation of alternative research agendas. Overall, the study demonstrates the analytic potential of the concept of undone science to deepen understanding of the systematic nonproduction of knowledge in the institutional matrix of state, industry, and social movements that is characteristic of recent calls for a ‘‘new political sociology of science.’’. BackgroundNational guidelines require programmes use subjective assessments of social support when determining transplant suitability, despite limited evidence linking it to outcomes. We examined how transplant providers weigh the importance of social support for kidney transplantation compared with other factors, and variation by clinical role and personal beliefs.MethodsThe National survey of the American Society of Transplant Surgeons and the Society of Transplant Social Work in 2016. Using a discrete choice approach, respondents compared two hypothetical patient profiles and selected one for transplantation. (...) Conditional logistic regression estimated the relative importance of each factor; results were stratified by clinical role and beliefs.ResultsFive hundred and eighy-four transplant providers completed the survey. Social support was the second most influential factor among transplant providers. Providers were most likely to choose a candidate who had social support, always adhered to a medical regimen, and had a 15 years life expectancy with transplant. Psychosocial providers were more influenced by adherence and quality of life compared with medical/surgical providers, who were more influenced by candidates' life expectancy with transplant. For providers concerned with avoiding organ waste, social support was the most influential factor, while it was the least influential for clinicians concerned with fairness.ConclusionsSocial support is highly influential in listing decisions and may exacerbate transplant disparities. Providers’ beliefs and reliance on social support in determining suitability vary considerably, raising concerns about transparency and justice. (shrink)

In critical care medicine, teaching and mentoring practices are extremely important in regard to attracting and retaining young trainees and faculty in this important subspecialty that has a scarcity of needed personnel in the USA. To this end, we argue that Foucault’s Technologies of the Self is critical background reading when endeavoring to effect the positive transformation of faculty into effective teachers and mentors.

In a longitudinal naturalistic study, we observed German mothers interacting with their infants when they were 3 and 6 months old. Pursuing the idea that infants’ attention is socialized in everyday interactions, we explored whether eye contact is reinforced selectively by behavioral modification in the input provided to infants. Applying a microanalytical approach focusing on the sequential organization of interaction, we explored how the mother draws the infant’s attention to herself and how she tries to maintain attention when the infant (...) is looking at her. Results showed that eye contact is reinforced by specific infant-directed practices: interrogatives and conversational openings, multimodal stimulation, repetition, and imitation. In addition, these practices are contingent on the infant’s own behavior. By comparing the two data points (3 and 6 months), we showed how the education of attention evolves hand-in-hand with the developing capacities of the infant. A fundamental fact about human minds is that they are never truly alone: all minds are steeped in situated interaction. That social interaction matters is recognized by any experimentalist who seeks to exclude its influence by studying individuals in isolation. On this view, interaction complicates cognition. Here, we explore the more radical stance that interaction co-constitutes cognition: that we benefit from looking beyond single minds toward cognition as a process involving interacting minds. All around the cognitive sciences, there are approaches (...) that put interaction center stage. Their diverse and pluralistic origins may obscure the fact that collectively, they harbor insights and methods that can respecify foundational assumptions and fuel novel interdisciplinary work. What might the cognitive sciences gain from stronger interactional foundations? This represents, we believe, one of the key questions for the future. Writing as a transdisciplinary collective assembled from across the classic cognitive science hexagon and beyond, we highlight the opportunity for a figure-ground reversal that puts interaction at the heart of cognition. The interactive stance is a way of seeing that deserves to be a key part of the conceptual toolkit of cognitive scientists. (shrink)

Multiteam systems are complex organizational forms comprising interdependent teams that work towards their own proximal goals within and across teams to also accomplish a shared superordinate goal. MTSs operate within high-stakes, dangerous contexts with high consequences for suboptimal performance. We answer calls for nuanced exploration and cross-context comparison of MTSs “in the wild” by leveraging the MTS action sub-phase behavioral taxonomy to determine where and how MTS failures occur. To our knowledge, this is the first study to also examine how (...) key MTS attributes influence MTS processes and performance. We conducted historiometric analysis on 40 cases of failed MTS performance across various contexts to uncover patterns of within- and between-team behaviors of failing MTSs, resulting in four themes. First, component teams of failing MTSs over-engaged in within-team alignment behaviors by enacting acting, monitoring, and recalibrating behaviors more often within than between teams. Second, failing MTSs over-focused on acting behaviors and tended to not fully enact the action sub-phase cycle. Third and fourth, boundary status and goal type exacerbated these behavioral patterns, as external and physical MTSs were less likely to enact sufficient between-team behaviors or fully enact the action sub-phase cycle compared to internal and intellectual MTSs. We propose entrainment as a mechanism for facilitating MTS performance wherein specific, cyclical behavioral patterns enacted by teams align to facilitate goal achievement via three multilevel behavioral cycles. We argue that the degree to which these cycles are aligned both between teams and with the overarching MTS goal determines whether and how an MTS fails. Our findings add nuance beyond single-context MTS studies by showing that the identified behavioral patterns hold both across contexts and almost all types of MTS action-phase behaviors. We show that these patterns vary by MTS boundary status and goal type. Our findings inform MTS training best practices, which should be structured to integrate all component teams and tailored to both MTS attributes and situation type. (shrink)

BackgroundAustralian health and medical research funders support substantial research efforts, and incentives within grant funding schemes influence researcher behaviour. We aimed to determine to what extent Australian health and medical funders incentivise responsible research practices.MethodsWe conducted an audit of instructions from research grant and fellowship schemes. Eight national research grants and fellowships were purposively sampled to select schemes that awarded the largest amount of funds. The funding scheme instructions were assessed against 9 criteria to determine to what extent they incentivised (...) these responsible research and reporting practices: publicly register study protocols before starting data collection, register analysis protocols before starting data analysis, make study data openly available, make analysis code openly available, make research materials openly available, discourage use of publication metrics, conduct quality research, collaborate with a statistician, and adhere to other responsible research practices. Each criterion was answered using one of the following responses: “Instructed”, “Encouraged”, or “No mention”.ResultsAcross the 8 schemes from 5 funders, applicants were instructed or encouraged to address a median of 4 of the 9 criteria. Three criteria received no mention in any scheme. Importantly, most incentives did not seem strong as applicants were only instructed to register study protocols, discourage use of publication metrics and conduct quality research. Other criteria were encouraged but were not required.ConclusionsFunders could strengthen the incentives for responsible research practices by requiring grant and fellowship applicants to implement these practices in their proposals. Administering institutions could be required to implement these practices to be eligible for funding. Strongly rewarding researchers for implementing robust research practices could lead to sustained improvements in the quality of health and medical research. (shrink)

Background:Clinical investigation is a growing field employing increasing numbers of nurses. This has created a new specialty practice defined by aspects unique to nursing in a clinical research context: the objectives, setting, and nature of the nurse–participant relationship. The clinical research nurse role may give rise to feelings of ethical conflict between aspects of protocol implementation and the duty of patient advocacy, a primary nursing responsibility. Little is known about whether research nurses experience unique ethical challenges distinct from those experienced (...) by nurses in traditional patient-care settings.Research objectives:The purpose of the study was to describe the nature of ethical challenges experienced by clinical research nurses within the context of their practice.Research design:The study utilized a qualitative descriptive design with individual interviews.Participants and research context:Participating nurses self-identified as having experienced ethical challenges during screening. The majority were Caucasian, female, and worked in outpatient settings. Approximately 50% had > 10 years of research experience.Ethical considerations:The human subjects review board approved the study. Written informed consent was obtained.Findings:Predominant themes were revealed: the inability to provide a probable good, or/do no harm, and dual obligations. The following patterns and subthemes emerged: conflicted allegiances between protocol implementation, needs of the participant, desire to advance science, and tension between the nurse–patient therapeutic relationship versus the research relationship.Discussion:Participants described ethical challenges specific to the research role. The issues are central to the nurse–participant relationship, patient advocacy, the nurse’s role in implementing protocols, and/or advancing science.Conclusion:Ethical challenges related to the specialized role of clinical research nurses were identified. More research is warranted to fully understand their nature and frequency and to identify support systems for resolution. (shrink)

Absolute velocities in Newtonian mechanics are commonly regarded as unmeasurable. Roberts (Br J Philos Sci 59(2):143–168, 2008) provides a justification for this thesis which appeals to the observational indistinguishability of boost-related models of Newtonian mechanics. Middleton and Murgueitio Ramírez (Australas J Philos, 2020) criticise his argumentation by pointing out that his analysis of the notion of measurement is too restrictive, and that, under a weaker analysis (based on counterfactuals), absolute velocities are measurable. Jacobs (Australas J Philos, 2020) opposes their view, (...) arguing that, on a properly formulated counterfactual-based account of measurement, absolute velocities are unmeasurable. However, in his argument, observational indistinguishability plays no role, even though, intuitively, it is very relevant for the issue of (un)measurability. This paper’s aim is to bring observational indistinguishability back to this discussion. I build upon the observation that there is an analogy between possible views on knowledge and justification on the one hand, and on measurement on the other. In particular, I explore the distinction between externalist and internalist approaches. Counterfactual-based accounts are all externalist, whereas the observational indistinguishability of boost-related models becomes relevant if we are interested in an internalist concept of measurement. Jak argumentują, analiza ta jest zarówno filozoficznie adekwatna, jak i teologicznie akceptowalna.

In this paper, I argue that the Hole Argument can be formulated without using the notion of isomorphism, and for this reason it is not threatened by the criticism of Halvorson and Manchak (Br J Philos Sci, 2022. https://doi.org/10.1086/719193). Following Earman and Norton (Br J Philos Sci 38, pp. 515–525, 1987), I divide the Hole Argument into two steps: the proof of the Gauge Theorem and the transition from the Gauge Theorem to the conclusion of radical indeterminism. In the analaysis (...) of the first step, I argue that the Gauge Theorem does not rely on the notion of isomorphism but on the notion of the diffeomorphism-invariance of the equations of local spacetime theories; however, for this approach to work, the definition of local spacetime theories needs certain amendments with respect to Earman and Norton’s formulation. In the analysis of the second step, I postulate that we should use the notion of radical indeterminism instead of indeterminism simpliciter and that we should not decide in advance what kind of maps are to be used in comparing models. Instead, we can tentatively choose some kind of maps for this purpose and check whether a given choice leads to radical indeterminism involving empirically indistinguishable models. In this way, the use of the notion of isomorphism is also avoided in the second step of the Hole Argument. A general picture is that physical equivalence can be established by means of an iterative procedure in which we examine various candidate classes of maps, and, depending on the outcomes, we need to broaden or narrow these classes. The Hole Argument can be viewed as a particular instance of this procedure. (shrink)

In the following paper the author presents and analyses J. Maritain’s social theory. The French Thomist attempted to associate the principle of common good (that plays the main role in the Christian social thought) with democracy. Maritain claims that only democracy can be regarded as an acceptable form of government, i.e. the one that satisfies rational and moral requirements (which, according to the Thomists, are the same). Such a statement put forward by the Thomist philosopher emphasises the necessity of asking (...) a number of questions of the human nature, human dignity and human autonomy; it also demonstrate how to introduce the ethical values into the realm of democratic politics, which in its turn is described as axiologically neutral by contemporary political theories. J. Maritain’s views on those issues were taken into consideration by Catholic intellectuals and were announced before the Second Vatican Council. Regarding the time they were widely opened to the contemporary ideas. Consequently, they contributed to the significant development of the current attitude of the Catholic Church to the present political and social problems. (shrink)

Analizując treści prac znaczących myślicieli Oświecenia, należy jednak dojść do wniosku, że Kantowskie słowa wskazujące jako ideę przewodnią Oświecenia: „Odważ się posługiwać własnym rozumem!”, nie odnoszą się do kobiety. Podmiotem myślenia filozoficznego pozostaje mężczyzna, choć używany w dziełach filozoficznych tego okresu (...) z upodobaniem i konsekwencją termin „człowiek” może pozornie wskazywać na ogólne zainteresowanie obiema płciami i równe traktowanie mężczyzn i kobiet. Kobiety nadal postrzega się jako istoty niższe pod względem umysłowym. Umieszcza się je w pułapce małżeństwa rozumianego jako związek tworzący „jedną osobę moralną”, czy też „jedną osobę duchową”. Zmiany w edukacji kobiet, choć w dobie Oświecenia się dokonały, nadal polegają na kontroli wiedzy im przekazywanej, a nadto wiedzy ukierunkowanej na uformowanie określonych cech związanych z rolą żony i matki. Wskazane zagadnienia w artykule są rozważane na przykładzie trzech myślicieli Oświecenia: J.-J. Rousseau, I. Kanta oraz H. Kołłątaja. (shrink)

All rights reserved.We present new observations of the low-mass companion to HD 984 taken with the Gemini Planet Imager as a part of the GPI Exoplanet Survey campaign. Images of HD 984 B were obtained in the J and H bands. Combined with archival epochs from 2012 and 2014, we fit the first orbit to the companion to find an 18 au orbit with a 68% confidence interval between 14 and 28 au, an eccentricity (...) of 0.18 with a 68% confidence interval between 0.05 and 0.47, and an inclination of 119°with a 68% confidence interval between 114°and 125°. To address the considerable spectral covariance in both spectra, we present a method of splitting the spectra into low and high frequencies to analyze the spectral structure at different spatial frequencies with the proper spectral noise correlation. Using the split spectra, we compare them to known spectral types using field brown dwarf and low-mass star spectra and find a best-fit match of a field gravity M6.5 ±1.5 spectral type with a corresponding temperature of K. Photometry of the companion yields a luminosity of log=2.88 ± 0.07 dex with DUSTY models. Mass estimates, again from DUSTY models, find an age-dependent mass of 34 ±1 to 95 ±4 M Jup. These results are consistent with previous measurements of the object. (shrink)

In this review of Donna J Haraway’s book, Manifestly Haraway, that brings together The Cyborg Manifesto, The Companion Species Manifesto and Companions in Conversation, the author aims to show how Haraway’s work taken together is inspiring and revolutionary, offering us a basis for thinking differently about how we can intervene in dominant power relations in ways that are not simply critical but constructive of new ways of doing and being a social scientist. Like Foucault before her, Haraway offers not just (...) exceptional tropes to think with – the cyborg, the companion species – but practices, ways of thinking and writing and relating, through which to make knowledge, and remake worlds. Making kin, becoming-with – not post-humanism but compost – these are the messages of her manifestos for doing our theorizing and our researching differently. (shrink)
